A Report from Countryside

There was bad weather a view days ago in Nijmegen. It was rainy and windy. However, actually it was storm that hit England, France, and the Netherlands. There were 9 people killed because of the storm. As Chrisye's song "Badai Pasti Berlalu", it is a very lovely weather today in Nijmegen. My friend and I go to the countryside. It is cold and a little bit windy but I don't want to miss the sun. So, here are some pictures for you, please enjoy a report from countryside...

Autumn in Nijmegen

Leaves already changed their color, now they're begin to fall. When the Daylight Saving Time (DST) starts in 1 p.m. in the last Sunday of October, then it's time to say goodbye to warm. In the European Union, Summer Time ends at 1:00 a.m. Universal Time (Greenwich Mean Time). It ends the last Sunday in October. In the EU, clocks fall back from 1:59 a.m. to 1:00 a.m, all time zones change at the same moment. Happy Sunday for all of you, we're welcoming winter now...

Interpreting The Concept of Appreciability for The Purpose of Applying Article 101 TFEU

Note: Article 85 EEC Treaty, which then renumbered as Article 81 EC Treaty, is now Article 101 TFEU.

Article 101(1) TFEU provides that all agreements between undertakings, decisions by associations of undertakings and concerted practices which may affect trade between Member States and which have as their object or effect the prevention, restriction or distortion of competition within the internal market are prohibited within the EU.
In order to analyze whether an agreement has its object or effect the prevention, restriction or distortion of competition within the internal market, it is important to first take a look at the wording of Article 101(1) TFEU. The use of “or” between object and effect shall be interpreted that they are alternative (not cumulative). This view is supported by the ECJ in the STM case[1].
